Terms of Service

These Terms of Service ("Terms") set out the conditions for using the FIGURO service ("the Service") provided by nextクリエイティブ合同会社 ("we"). Please agree to these Terms before using the Service.

1. Application

These Terms apply to all relationships between you and us regarding the Service. Our Privacy Policy, Notice under the Act on Specified Commercial Transactions, Shipping & Returns, and AI Generation Consent ("Specific Rules") form part of these Terms; where they conflict, the Specific Rules prevail.

2. Accounts

You must register accurate information and manage your sign-in methods (email, LINE, etc.) at your own responsibility. Acts performed using your sign-in are deemed yours. Minors must have a parent or guardian's consent.

3. Photos and likeness

You warrant that photos you upload are of yourself, or a person who has consented (for a minor, with a guardian's consent), and that you hold the necessary rights. We cannot make figures of third parties, public figures or existing characters without the rights holder's permission. We check uploaded photos automatically and by hand, and may decline anything other than a photo of one real person or one pet (existing characters or costumes of them, several people or animals, inappropriate content, etc.). Your own original illustration, avatar or figurine (or a drawing of you or your family) may be accepted after you confirm it is original and that you hold the rights, and after a check by our team. If this is found after you order, we cancel the order and refund you. You will resolve any resulting dispute with a third party at your own responsibility and expense.

4. AI previews and generated content

• Preview images are AI-generated illustrations; the actual product differs in shape, colour and detail due to printing constraints.
• Products are 3D-printed. Layer lines, support marks, simplified detail due to the limited number of colours, colour differences from your screen and small size differences will occur; these are characteristics of the process, not defects (see Shipping & returns).
• After you order and before printing, we email images and a video of your 3D model. Please review and approve it. Design changes or revisions are not offered (if the 3D model clearly differs from the preview you approved, please contact us). If we receive no reply within 72 hours of sending, the model is deemed approved and production begins.
• You may use your own previews and products privately and share them on social media. Contact us before any commercial use.
• We will obtain your separate consent before using your photos or generated content in advertising or showcases.

5. Orders and formation of contract

A sales contract is formed when you complete payment after reviewing the order screen and we send the order confirmation email (for konbini payments, when payment is confirmed). We may decline orders for reasons such as production capacity or breach of these Terms, in which case any payment is refunded in full.

6. Prices and payment

Product prices (tax included), shipping and option fees are shown on each page and the order screen. Payment methods are those shown on the order screen, such as credit card, Apple Pay, Google Pay and konbini.

7. Production and delivery

Products are made to order. The estimated delivery date on the order screen is calculated from the production queue at the time of order and may change due to demand, materials, natural disasters or carrier conditions. We will contact you if there is a significant delay.

8. Cancellation and returns

As products are made to order, we cannot accept cancellation, returns or exchanges for your convenience once payment is complete. Defects or shipping damage reported within 7 days of arrival are remade free of charge, or refunded if a remake is not possible. Figures made as per the 3D model you approved (including deemed approval) are not remade or refunded for reasons of impression or taste. See Shipping & returns for details.

9. Credits

• Credits used for AI customization etc. can be used only within the Service and cannot be exchanged for cash or product payments, or transferred.
• Purchased credits are non-refundable except where required by law. Free sign-up credits are limited to one per person and may not be granted to multiple accounts created from the same device or connection. Free credits may be changed or discontinued without notice.
• Style previews from your photo are free up to 12 in total per account; after that each new style uses 1 credit (returned if generation fails). Preview images carry a watermark.
• Customers who buy a figure receive thank-you credits (20 per order) when it ships. This benefit may be changed or ended without notice.
• Credits are valid for 6 months from the date they are granted (purchased or given free). Unused credits lapse after that and cannot be refunded or extended. The credits expiring soonest are used first.
• If the Service ends, we will refund unused purchased credits in accordance with law.

10. Coupons

Coupons can be used one per order within their stated validity and conditions, and cannot be exchanged for cash or resold. We may cancel discounts obtained or used improperly.

11. Affiliates and referrals

Affiliate/referral partners are subject to separate conditions set by us. Partners must clearly disclose that their content is advertising (e.g. "PR" or "Ad") and comply with Japan's Act against Unjustifiable Premiums and Misleading Representations and other laws. Commissions are paid monthly for orders with no return or defect claim 14 days after shipping.

12. Prohibited conduct

• Using images that infringe others' rights (likeness, copyright, trademark, privacy, etc.)
• Using obscene, violent, discriminatory or otherwise illegal or immoral content
• Interfering with the Service, unauthorized access, automated mass use, or circumventing limits
• Registering false information, impersonation, or improperly obtaining coupons or credits
• Any other conduct we reasonably consider inappropriate

13. Suspension

If you breach these Terms, we may suspend your use of the Service, cancel orders or delete your account without prior notice.

14. Intellectual property

Rights to our trademark (FIGURO), designs, base design and software belong to us or the rightful holders. Rights to photos you upload remain yours.

• We do not make figures that reproduce existing characters from anime, manga, games, films etc., mascots, costumes or cosplay of them, or third-party logos, trademarks or brand names, unless the rights holder has given permission. We check uploaded photos and AI-customize instructions automatically and by hand, and may decline anything that may fall under this.
• Logos, text or patterns on clothing etc. may be omitted or replaced with a generic design to protect third-party rights.
• Even after you order or approve, if we judge that a figure may infringe third-party rights, we will cancel the order and refund you (this also applies if it has already been produced; such items will not be delivered).
• For rights holders: if you believe content or products made through the Service infringe your rights, email info@figuro.jp with the item, the right concerned and your contact details. We will review promptly and, where appropriate, take it down or stop production.

15. Disclaimer and limitation of liability

The likeness and finish of AI-generated content vary with photo quality and style; a perfect match is not guaranteed. We are not liable for delays or interruptions caused by force majeure, such as natural disasters, network failures or outages of external services. Where we are liable for damages, except in cases of our intent or gross negligence, our liability is limited to the amount paid for the order concerned.

16. Exclusion of antisocial forces

You represent and warrant that you are not, and have no relationship with, organized crime groups or other antisocial forces. If this proves untrue, we may terminate the contract immediately.

17. Changes to or termination of the Service

We may change or end the Service with prior notice to you.

18. Changes to these Terms

We may change these Terms in accordance with Article 548-4 of the Civil Code, announcing the changes and their effective date on the Service a reasonable period in advance.

19. Severability

If any part of these Terms is held invalid, the remaining provisions remain in effect.

20. Governing law and jurisdiction

These Terms are governed by Japanese law. Any dispute regarding the Service is subject to the exclusive jurisdiction of the Fukuoka District Court as the court of first instance.
